Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Belfort's website, dashboard, APIs, and SDKs (the “Services”). By creating an account or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you agree on its behalf.

Accounts

You must provide accurate account information and are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

Acceptable use

You agree not to misuse the Services, including by attempting to disrupt them, reverse-engineer them except as permitted by law, use them to violate any law, or serve paywalls containing unlawful, deceptive, or infringing content.

Subscriptions & billing

Paid plans are billed in advance on a recurring basis. Fees are non-refundable except as required by law or expressly stated. We may change pricing with at least 30 days' notice, effective on your next billing cycle. Overages beyond your plan's MAU allowance may be billed at the then-current rate.

Customer data

You retain all rights to the data you and your end users submit to the Services (“Customer Data”). You grant us a limited license to process Customer Data solely to provide the Services, as further described in our DPA.

Intellectual property

We and our licensors own the Services and all related intellectual property. These Terms grant you no rights to our trademarks or branding except as needed to use the Services.

Confidentiality

Each party may access confidential information of the other. The receiving party will protect it with reasonable care and use it only to perform under these Terms.

Disclaimers

The Services are provided “as is.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any specific conversion, revenue, or experiment outcome.

Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, or consequential damages, and each party's aggregate liability will not exceed the amounts you paid us in the 12 months preceding the claim.

Termination

You may cancel at any time. We may suspend or terminate access for material breach or unlawful use. Upon termination, your right to use the Services ends and we will handle Customer Data as described in the DPA.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in San Francisco County, California.

Changes

We may update these Terms from time to time. Material changes will be communicated through the Services or by email, and your continued use constitutes acceptance.
